Whistleblower fights back after frivolous suit by FHTM for exposing their ILLEGAL Pyramid Scheme

Lexington, Kentucky – June 16, 2010 – In light of all of the recent investments scams including the infamous Bernie Maddoff, whistleblowers and those with morals fear that the frauds they expose will result in unjust lawsuits filed against them by the companies they complain about. One such situation was that of the lawsuit filed by Fortune Hi-Tech Marketing against Fortune Social LLC and Joseph Isaacs in May 2010.

Joseph Isaacs and Fortune Social, LLC (collectively “Isaacs”) deny each and every claim brought by Fortune Hi-Tech Marketing, Inc. (“FHTM”) in a filing made today with the American Arbitration Association, who is overseeing this case. In addition, Isaacs fights back and asserts his own counterclaim for relief against FHTM, Paul C. Orberson (individually and in his capacity as President of FHTM), Jeff Orberson (individually and in his capacity as Chief Operating Officer of FHTM), and Thomas A. Mills (individually and in his capacity as Vice-President and Chief Executive Officer of FHTM) (collectively “FHTM”). Isaacs counterclaim claim Breach of Fiduciary Duty, Breach of Contract, Common Law Fraud, Unfair & Deceptive Business Practices, Failure to Register Securities, Fraudulent Practices Regarding the Sale of Securities, Civil Racketeering Conspiracy (violation of the Federal RICO statutes) and Defamation.

FHTM operates an unlawful product-based endless recruiting pyramid scheme that relies on untrue and misleading representations and unlawful, unfair, and fraudulent business practices. While FHTM purports to be in the business of selling name-brand services like wireless, satellite television, home security, vitamins, nutritional products and travel services, its true business is using consumers to generate fee income for representing non-existent partnerships, major sports figures, and prominent businessmen. To entice consumers to participate, FHTM makes untrue or misleading claims regarding its relationship with Fortune 100 companies like Verizon Wireless, GE Security, Dish Networks and Travelocity to create the illusion that consumers can become millionaires in three to five years.

FHTM’s growth exploded when it began to lure consumers disenchanted with traditional jobs and the recession that began in 2007 to inspirational and high-pressure business opportunity seminars touting an innovative business model that promises huge financial rewards through multi-level network marketing. FHTM erring presenters claim to have proprietary tools, special relationships, and other support that allow consumers to grow their own business by partnering with FHTM’s “companies”.

It would not be long before Isaacs (and the world) made several troubling discoveries about FHTM’s business plan and practices that doused his enthusiasm: (1) Paul Orberson had not made any special arrangements with the companies mentioned at the business opportunity/presentation seminar or in the company produced videos; (2) the only way to earn a significant income and be promoted up the ranks was to recruit additional IRs; (3) FHTM had not received regulatory approval for its pyramiding scheme in every state; (4) only a handful of IRs had earned anywhere near the residuals projected; (5) the prominent businessmen, politicians, former attorney generals and sports figures to whom FHTM constantly alluded were in fact IRs actively promoting their own FHTM business; and (6) a growing number of state attorneys general had already begun investigating FHTM in response to numerous complaints.

It turns out that FHTM’s ‘innovative’ marketing plan is nothing more than a face lift to an age-old scheme. According to the FTC’s Consumer Protection Bureau:

Pyramid schemes now come in so many forms that they may be difficult to recognize immediately. However, they all share one overriding characteristic. They promise consumers or investors large profits based primarily on recruiting others to join their program, not based on profits from any real investment or real sale of goods to the public. Some schemes may purport to sell a product, but they often simply use the product to hide their pyramid structure. There are two tell-tale signs that a product is simply being used to disguise a pyramid scheme: inventory loading and a lack of retail sales. Inventory loading occurs when a company’s incentive program forces recruits to buy more products than they could ever sell, often at inflated prices. If this occurs throughout the company’s distribution system, the people at the top of the pyramid reap substantial profits, even though little or no product moves to market. The people at the bottom make excessive payments for inventory that simply accumulates in their basements. A lack of retail sales is also a red flag that a pyramid exists. Many pyramid schemes will claim that their product is selling like hot cakes. However, on closer examination, the sales occur only between people inside the pyramid structure or to new recruits joining the structure, not to consumers out in the general public.

Nonetheless, the truth is catching up with FHTM. On December 10, 2009, The North Dakota Attorney General’s Office filed a Cease and Desist Order for violation of the Consumer Fraud Law, the Transient Merchant Law, the Home Solicitation Sales Law, and the North Dakota Pyramid Schemes Act. On January 19, 2010, FHTM entered into a Assurance of Voluntary Compliance with the North Dakota Attorney General’s Office. On March 16, 2010, the Montana State Auditor’s Office filed a Temporary Cease and Desist Order against FHTM, Paul C. Orberson, Thomas A. Mills, and Dianne Graber (a Montana IR). According to the Montana State Auditor’s Office, FHTM has engaged in acts or practices constituting violations of the Securities Act of Montana, Montana Code ANN.30-10-101 et seq. On April 22, 2010, FHTM agreed to pay nearly $1 million and to change its business practices to resolve the charge that it is operating a pyramid promotional scheme.

With each passing day, more states are jumping on FHTM’s bandwagon. The alarming rise in consumer complaints and governmental sanctions has prompted the Better Business Bureau of Central and Eastern Kentucky to downgrade FHTM’s rating from “B-” to “F”. At the same time, a proliferation of online bulletin boards and blogs, such as http://www.complaintsboard.com and http://www.scams.com criticize FHTM’s pyramid scheme confirms that Isaacs’ experience is not unique. Will those operations be the next target of Fortune’s high price legal team?

An illegal pyramid scam or scheme is not even close to describing FHTM. In fact, it is clearly defined on the http://www.ftc.gov. website. Go find it and do your research. We have products and services, which is required in this industry. DID YOU KNOW THIS: Amway and Herbalife and many other top companies in this industry were all shut down in nearly DOZENS of states on their way to the top. Amway is now #2 WORLDWIDE and is a reputable company. Avon is #1. Every company has had representatives who were not ethical or made exaggerated promises.

Joseph Issaccs is in DEEP CACA for the illegal things he has posted on the internet, lies he has posted, articles, stories he told TV stations that ran his lies on newscasts, later to apologize. He owes everyone a sincere apology for his unacceptable behavior. He obviously believed in the company, and was even at the free cruise this year, celebrating with all of us.

This company has been the answer to many regular, non-sales persons prayers. Even my husband and I who have only been in the business 15 months, have found that by helping others on our team be successful and make money, we in return make money. All the money is from the advertising budgets of the companies associated with FHTM. It’s simple, AND LEGAL. You just are not educated on our business enough to understand, and many people think it’s too simple to work…..BUT IT DOES! :O)

You sound like every other close of the Orberson scam. Mr. Isaacs did nothing illegal by spreading the news about the FHTM pyramid scam and he NEVER apologized for telling the truth.

Anyone can send loyal customers to those big companies. FHTM is built for the average person to FAIL! Less than 1/2 of 1% (according to FHTM’s own disclosure statements) make any sizable money.

Ever wonder why there are only 7 Presidential Ambassador’s and none have been added in over five years? NOBODY else will get to those levels as the positions were bought due to special deals Paul made with those individuals.

Having 2 has-been attorney generals on the Legal Advisory Board does nbot lend credibility. Any normal business man would know that.

You bought your farm out of bankruptcy because of Fortune? Obviously you fit into the perfect IR mold – broke, stupid, bankrupt or all 3.

PS. FHTM did NOT give you a Lexus. They pay you 600.00 a month and you lease one! GOD has nothing to do with this scam and I am so tired of hearing all of these brainwashed reps say he does.

There are people making money in Fortune and that is why you have people who are so hard pressed to see the truth. No goverment agency is going to call you an illegal business and then fine you if you were dong business legally!
Judy Hamerschmidt is one of the best attorneys in the country , yet two states have filled charges against Fortune with her at the head of the legal table. Having two more former AGs on your payroll does not make you more legal, it just means that they are there to try and make you look better in the grey area that Fortune is in.
I do not know Joe Isaacs but have read the lawsuit and see where he has won on several actions in court. I know I have had problems with the company and tried to work them out but after seeing an attorney he told me that he believes this company to be a pryamid scheme and that it would cost me more to fight them than what it is worth. But the huge comment was , because he was an officer of the court he was going to have to let the goverment know what was going on and that if I did not get imunity from them , that I and everyone else that was in the company could go to jail for being part of this scam! No wonder more people have not reported them!
I am scared to death!
When you read the Montana orders and see everything that all of us have been lied to about, how can you really believe that there is not something very wrong here?

Mr. Moorehouse you have made some great points on here. If FORTUNE had nothing to hide then why are they trying so hard to shut anyone up who dares to question why if they were legal that all of this is happening!

I hope that FORTUNE settles with everyone and does the right thing otherwise the rumors will never stop and you will never see more than one person like yourself defending them only because you cant admit the truth to yourself that your farm was saved because others lost..
If this is not true that your income that saved your farm did not come from recruiting then show your checks and we will see how much came from residual income from product sales.
I have yet to see anyone from FORTUNE who could show us anything other than bonuses from recruiting .
Enjoy it while you can, because when the Isaacs case gets to court I do believe their world will come tumbling down.

You make some valid points. If FHTM was such a stand up legal company and Paul Orberson has the integrity of a saint then the problems in North Dakota, Montana, the BBB in KY would never have been there in the 1st place.

Why is it that every leader from the former bankrupt Excel has started his own MLM and has been shut down as a pyramid scam or been sued in a class action (or both). It seems like the research tells the truth and the cloned reps are drinking too much of the kool-aid.

Louisville, KY: A giant pyramid scheme that has been masquerading as a marketing company appears to be starting to crumble. The only “fortune” the company created went mostly to the company’s father figure, Paul Orbison, and a short list of his confederates.

Fortune Hi-Tech Marketing Hit with National Class Action. Although Fortune Hi-Tech Marketing purports to sell everything from hair care products to cell phones, the real sales job was done on potential recruits to the organization.

“The law against pyramid schemes is clear,” says R. Kenyon Meyer, an attorney who works with the well-known firm of Dinsmore and Shohl in Louisville, Kentucky. Meyer represents four former Fortune sales representatives in a national class action alleging they were victims of Orbison’s operation.

According to the suit, sales representatives were charged $299 for the privilege of joining the Fortune team. Then they were pressured into buying a never-ending stream of services and equipment in order to do the job, says Meyer, who has been researching the company for several months now.

“Fortune requires sales representatives to get ‘frequent customer points.’ Those points are obtained not by selling something, but by signing up for something in order to do your job as a representative!”

Just because Fortune maintained a list of products for sale doesn’t mean it isn’t a pyramid scheme, warns Meyer. “Every pyramid scheme has some product that it purports to promote. The focus on recruitment overrides the focus on the sale of a product to the ultimate consumer meaning somebody not involved in the pyramid.”

Fortune Hi-Tech Marketing was recently routed in a Montana state class action where regulators successfully litigated against the company for operating a pyramid scheme.

Orbison, who lives and operates Fortune from Lexington, Kentucky, tells recruits he was able to retire after he made a million dollars month with another multi-level marketing company. He started Fortune in order “to give back” and allow others an opportunity to get rich.

Meyer’s clients, however, would prefer that Fortune simply give back the money they were duped into pouring into a pyramid scheme. According to the research done by Dinsmore and Shohl, the majority of sales reps actually made less than $90 dollars a month before expenses.

There may be thousands of potential class members across the US and even in Canada and Britain, but Fortune is unclear about how many sales representatives it actually has on the books. “They have made some vague representations from time to time, like we have had tens of thousands of representatives join in the last couple of months,” says Meyer. “But there have been no official numbers released.”

Every website or article you post about negative things regarding FHTM is all tied to, and I can prove it, a man named Joseph Isaacs who was kicked out of FHTM by trying to force the company to pay for a website he built as a FHTM forum.

I am in contact with almost every NSM named in the “class action” lawsuit, and things are getting ready to turn real bad for those posting lies about FHTM.

Joseph Isaacs in particular is very close to finding himself in court, not only against FHTM, but he will find out what a real class action lawsuit is.

Business is about educating and integrity, Paul Orberson integrates both better then any other in this company. I am a devoted soldier to this country and my career and life is based on integrity and i know it when i see it. I just got back from afghanistan from my year long+ deployment to fight for the country and people i love and it pains me to see so many ignorant people not find out the facts and truth about this great company and what this man has done to try to help people. I have not met Paul Orberson but i would in a heart beat give my life for someone who cares so deeply for people and someone who has effected and changed so many lives in a positive manner. Paul cannot change everyones life, at the end of the day it is about the work you put in not just the opportunity alone so anyone who blames paul is so ignorant it baffles me. Anyone who has anything negative to say needs to close it because you obviously dont know how to do real research and find out allllll the facts not just negative…for you who think google or bing is research you are so far from right you might as well not be american. For you too only post negative facts Paulie Moorehouse shows hows arrogant your influences have made you. Google walmart scam and see how many lawsuits you find, or any company for that matter….there will always be negative about every company and any uneducated fool can post,blog, or make accusations anywhere . Bottom line i would show this company to all my military brothers and sister and really anything Paul does to help people.
